The AI regulation challenges in Brazil

Since the boom of generative artificial intelligence and the increased popularity of artificial intelligence usage, the world faces the challenge of regulating artificial intelligence. Brazil is among the democracies that have a bill under discussion to regulate artificial intelligence, Bill PL 2.338/2023. The bill has already had several improvement proposals and includes 12 amendments. It is understandable why the bill takes time for maturation and approval; artificial intelligence is something new and constantly changing. Creating a bill that addresses the main challenges and proposes the best legal solutions is quite complex.

According to Senate news, there was a proposal to vote on the bill on July 12th, but there was a consensus, and the bill was postponed again.

In the meantime, the National Data Protection Authority (ANPD) ordered Meta to suspend its new privacy policy, which would allow the company to use data from users' open publications, such as photos and texts, to train generative artificial intelligence (AI) systems. It was understood that the change proposed by Meta violates the General Data Protection Law, as there was no prior communication to users nor their consent. After the decision, Meta appealed, but the ANPD upheld its decision.

Regarding the bill, there is a forecast of a new voting attempt for next month.
